Terms of use

Welcome to Checkpoint Daily. These terms of use (the “Terms”) govern the use of the site and form a binding agreement between the user and the site operator. Please read them carefully. Any use of the site constitutes acceptance of the Terms. If you do not agree to them, please do not use the site.

1. Definitions

“The site”: the website at thecheckpointdaily.com, including all of its pages, in Hebrew and in English.

“The site operator”: Barak Eliyahu, who operates the site and is responsible for it.

“User”: any person who browses or uses the site in any way.

“Content”: all information on the site, including articles, news flashes, columns, texts, images, videos, design, marks, logo and code.

“User content”: comments and any other content a user publishes on the site.

2. Use of the site

The site may be used for personal, non-commercial purposes, in accordance with the Terms and any applicable law.

You may not:

• republish, distribute or make commercial use of the content, including systematically or by automated means, without the site operator’s prior written consent, except as set out in section 7;
• harm or attempt to harm the operation or security of the site or the servers it runs on, including by malicious software or deliberate overload;
• circumvent security or spam-protection measures;
• use the site for any unlawful purpose.

The site operator may block access to the site, or to parts of it, for anyone who breaches the Terms.

3. Nature of the content and responsibility for information

The content of the site is journalistic content and general information. The site operator makes reasonable efforts to keep it accurate and up to date, but does not guarantee this. The content may contain errors or inaccuracies, and information may change after publication.

Information from other parties, such as company announcements and media reports, is presented with its source. Reports not yet confirmed by the official party are labeled as rumors.

If you find a mistake, please contact the site operator under the corrections policy on the About page. Every message is checked, and mistakes are corrected promptly.

4. Prices, offers and free games

Prices, discounts, offer dates and terms are presented as the store displayed them at the time of publication, for information only. Stores change prices and terms, and the binding price and terms are those displayed by the store at the time of purchase.

The site operator does not sell any products or services and is not a party to any transaction. Any purchase, payment, cancellation, refund or support is between the user and the store, under the store’s terms.

Before any purchase, the user should confirm the price, platform, region and terms at the store.

5. Stocks columns

The stocks columns are a journalistic summary only. They should not be regarded as investment advice, investment marketing or a recommendation to buy, sell or hold any security, and they are not a substitute for investment advice that takes into account each person’s data and needs.

The writers and the site operator have no personal interest in the companies in the columns and hold no shares in them.

Every investment decision is the sole responsibility of the user.

6. Comments and user content

Comments are published immediately, without prior review, and are visible to anyone reading the article. The site operator does not review comments before publication and is not responsible for their content.

The user is solely responsible for the user content they publish.

You may not publish user content that:

• is abusive, racist, inciting, threatening or obscene;
• may constitute defamation or an invasion of privacy, including publishing another person’s personal details;
• infringes copyright, trademarks or any other third-party right;
• is advertising, marketing or spam;
• impersonates another person;
• is otherwise unlawful.

By publishing user content, the user grants the site operator a free, non-exclusive and perpetual license to display it on the site.

The site operator may, at its discretion, hide or delete any user content, without prior notice.

Any user may report a comment with the “Report” button next to it, or through the contact page.

The information stored when a comment is published is described in the privacy policy.

7. Intellectual property

All rights in content created for the site, including articles, texts, design, the name Checkpoint Daily and the logo, are reserved to the site operator.

You may quote a short excerpt from an article, with the site’s name and a link to the article, and you may link to any page of the site. You may not copy an entire article or a substantial part of it, or republish it, without prior written consent.

Images, videos, game names, trademarks and other third-party materials belong to their owners. They appear on the site for news reporting, with credit, as fair use under section 19 of the Israeli Copyright Law, 2007, or with their owners’ permission.

A rights holder who believes that their work is used on the site unlawfully is asked to contact the site operator through the contact page, stating the work, the address on the site where it appears, the right claimed and their contact details. The request will be reviewed and, if found necessary, the work will be removed promptly.

8. Third-party links and content

The site contains links to other websites, such as sources and stores, and some articles include an embedded YouTube player. The content, terms and privacy policies of those sites and services are not under the site operator’s control, and their use is subject to their own terms.

A link to another site does not constitute an endorsement of it or responsibility for its content.

9. Availability of the site

The site is provided as is and as available. The site operator does not guarantee that the site will operate without interruption or errors.

The site operator may change, suspend or discontinue the site, or any part of it, at any time.

10. Limitation of liability

To the extent permitted by law, the site operator will not be liable for any damage, direct or indirect, arising in connection with the use of the site, including damage caused by reliance on the content, by an error in it, by a purchase at a store, by third-party content, by user content or by an interruption of the site.

Nothing in this section limits any liability that cannot be limited by law.

11. Indemnity

The user will indemnify the site operator for any damage, expense or payment, including reasonable legal fees, caused to it by the user’s breach of the Terms or of the law, including because of user content they published.

12. Privacy and accessibility

The information collected on the site, and how it is used, are described in the privacy policy, which forms part of the Terms.

13. Changes to the Terms

The site operator may update the Terms from time to time. The updated version takes effect when it is published on the site, and the date of the last update appears at the bottom of the page. Continued use of the site after an update constitutes acceptance of the updated version.

14. Governing law and jurisdiction

The Terms and the use of the site are governed solely by the laws of the State of Israel. The competent courts in Israel have exclusive jurisdiction over any matter relating to the Terms or the site.

15. General

If any provision of the Terms is held invalid, the remaining provisions will remain in force.

The site operator’s failure to exercise any right under the Terms does not constitute a waiver of it.

The Terms are published in Hebrew and in English. In case of any conflict between the versions, the Hebrew version prevails.
